Philippines Supreme Court quashes plea against Cathay Pacific

THE Philippines Supreme Court has quashed a plea to cite Hong Kong's Cathay Pacific Airways for contempt after allegedly breaching a contract with a warehousing company at Ninoy Aquino International Airport (NAIA).


Manila Business World reported that the Supreme Court dismissed a petition by the People's Air Cargo and Warehousing Co to reverse a ruling by Judge Francisco Mendiola of Pasay City Regional Trial Court who quashed the petition wanting to cite Cathay for violating a deal made in 1997.


According to the petition, Cathay was not using the facility for "inbound and warehousing storage of import transit cargo arriving at Ninoy Aquino International Airport" as was provided in the contract.


On May 2004, People's Air Cargo filed a complaint for specific performance with plea for injunction and damages, against Cathay Pacific before the Pasay court.


But the high court, in its latest ruling, said the petition lacked merit, saying the motion should have been filed first before the Court of Appeals.
